Obama Tax Hike on Small Business Would Chill Hiring

?Would raising taxes on the wealthiest Americans have a chilling effect on hiring in this country?? When asked this question by Today?s Matt Lauer, Warren Buffett confidently answered, ?No.? How could this be, when the tax hikes desired by President Obama would fall directly on some of America?s most successful job creators?

As Kris Roglieri wrote in The Washington Post:

What policymakers fail to realize is that most small business owners, who also employ most of the country?s workforce, declare their business profits on the owner?s personal income tax return and are taxed at the personal income tax rate. Given that the net income number for many will be over $250,000, the proposed tax hikes could have a dramatic effect on small businesses and the growth and hiring decisions they will make. Another point policymakers overlook is that business owners will ultimately pass this cost on to the middle class by raising prices on goods and services, possibly triggering layoffs and stalling hiring.

Professor George Haynes of Montana State University analyzed small business employment based on the Federal Reserve Survey of Consumer Finances and found that those small businesses run by families earning more than $250,000 per year employ 93 percent of the people working in small businesses. Raising these businesses? taxes means that they have fewer resources available to invest and create jobs.

Based on data from the President?s own Treasury Department, tax hikes on upper-income earners would directly fall on 91 percent of income earned by job-creating businesses that pay their taxes through the individual income tax, which are known as flow-through businesses. (continues below chart)

Successful small businesses face a double whammy from the Obama tax hikes. In addition to allowing the Bush tax cuts to expire for wealthy Americans, President Obama?s signature health care law will raise their taxes yet further. As Heritage?s Curtis Dubay explains:

The higher tax rate on wages and salaries will cause workers to cut back on their hours, which will slow economic growth. It will also deter job creation at small businesses. The income of certain small businesses (sole proprietorships) is wage and salary income to the owner. As both employee and employer, the owner therefore pays the entire newly increased 3.8 percent [hospital insurance] tax rate. With more of the owner?s?and therefore the business?s?income taken by higher taxes, the owner will have fewer resources to invest back into the business to create jobs.

The answer to whether raising taxes on upper-income Americans would chill hiring is an emphatic yes?especially because those taxes fall on some of the nation?s biggest job creators. Lawmakers should avoid tax hikes on all Americans?no matter what Warren Buffett and other supporters of higher taxes would have you believe.

In-Laws And Marriage Study: Son-In-Law Key To Lasting Marriage

The holiday season usually means more quality time with the in-laws, and according to recent research, it's imperative that everyone get along.

A 26-year longitudinal study found that when a husband reported having a close relationship with his wife's parents, the couple's risk of divorce decreased by 20 percent. Conversely, when a wife reported having a close relationship with her husband's parents, the couple's risk of divorce increased by 20 percent.

Terri Orbuch, psychologist and research professor at the University of Michigan, began the study in 1986 with 373 couples in their first year of marriage, and followed up with them over time. She told the Wall Street Journal that she believes the findings are due to the different ways husbands and wives approach their relationships with their in-laws.

"Women value a close relationship with their in-laws but may ultimately view them as meddling, while men are more interested in providing for their families, and take their in-laws' actions less personally," Orbuch said. "Because relationships are so important to women, their identity as a wife and mother is central to their being. They interpret what their in-laws say and do as interference into their identity as a spouse and parent."

Wives also pay close attention to their own parents' relationships with their husbands. In the video above, Wall Street Journal columnist Elizabeth Bernstein suggests that when a husband makes an effort to get along with his wife's parents, his wife feels taken care of, too.

"He has forged a relationship with them, and that reads to his wife as if, boy, he cares about me if he's going to bother with my parents. If he's going to take care of my parents, he's going to get to know my parents, [then] he really cares about me," Bernstein said.

Orbuch advises parents of sons to be mindful of behavior their daughter-in-law may interpret as "meddling," while parents of daughters should be open to bonding with their sons-in-law. Wives should maintain boundaries with their in-laws, and husbands should remember to take care of their in-laws and treat them as important.

Delegates are meeting in Beijing to begins the once-in-a-decade power transfer for a change in Chinas leadership. While Americans celebrate the power of the ballot with the re-election of President Barack Obama, China's ruling Communist Party on Thursday launched a tightly orchestrated gathering in Beijing for a transition of power to a new generation of leaders amid tough challenges.

To the applause of some 2,000 party officials from across the country, outgoing Party leader President Hu Jintao, 70, reaffirmed in a lengthy speech the party's right to govern, with a ringing endorsement of the achievements during his 10 years in office.

In that span of time, China's economy quadrupled in size, leapfrogging to No. 2 from No. 5 in global economic ranking, and amassing the strategic global clout that the country wields today.

The week-long event is expected to culminate in the election of Xi Jinping, 59, as China's next top party leader. And when China's parliament convenes early next year, Xi is expected to be named China's president, acquiring by then the full authority with which he will co-manage with Obama the delicate course of Chinese-American relation.

The striking contrast between the Chinese and American models of governance, which were playing out at the same time, was certainly not lost to the media handlers of the Chinese party congress.

Embassy ballots give Chinese a glimpse of democracy ahead of power transfer

In a pre-congress media event, NBC News posed the issue of whether China will eventually adopt democratic reform and popular elections.

''The leading position of the Chinese Communist Party is a historic choice, a people's choice,'' responded Cai Mingzhao, the congress spokesman, dismissing any prospect of multiparty politics.

Hu's swan song Thursday reinforced China's path of gradual reform, which prizes harmony and stability in times of rapid change. Still, China observers concede that a smooth party congress will mark only the second peaceful transfer of power in Communist China's otherwise tumultuous history.

Revelations of vast fortune held by Chinese leader's family may hurt Communist Party image

Before the 2002 change of leadership from then-president Jiang Zemin to Hu Jintao, all succession plans involving the designated heirs of Chairman Mao and even Deng Xiaoping ended up in bloody and tragic power struggles.

China's leadership transition is also seen as a vindication of China's reform that sets an age limit on top leaders, a practice not yet adopted by other modern nations, according to scholars.

The Hu-Wen legacy
Despite China's enormous gains in the past 10 years, the jury is out on the legacy of Hu and his close political partner, Premier Wen Jiabao.

''They have laid the foundations of a meaningful social safety net, in terms of health insurance, retirement pensions, unemployment benefits, and more recently subsidized housing while keeping a rather high economic growth rate,'' said Jean-Pierre Cabestan, a professor of government and prominent China scholar at the Hong Kong Baptist University.

''But 'lay the foundations' is important because a lot remains to be done in terms of reimbursements and coverage,'' Cabestan told NBC News.

''Hu has introduced a series of very important concepts such as scientific concept of development, harmonious society, and pro-people approach but has yet to implement them,'' said?Bo Zhiyue, expert on China's elite politics at the National University of Singapore.

Chinese say one child is enough as Beijing weighs end of policy

Premier Wen represents the ''human face'' of the Chinese communist leadership, according to?Li Cheng, a top China scholar of the Brookings Institution.

''Some critics may doubt the sincerity of Wen's human face, but it was effective among a vast number of farmers and migrant workers in the country, especially for groups like AIDS orphans, coal-miners and families of earthquake victims,'' Cheng said in an earlier email interview.

CNBC's Michelle Caruso-Cabrera reports on China's selection of new leaders to meet public calls for better government and give the economy a boost.

''Liberal intellectuals in the country consider Wen as the most important political ally, especially for Wen's long-standing argument for universal values of democracy,'' he added.

However, recent reports of corruption involving family members and a protege seem to have tarnished both Wen and Hu, with Wen reportedly urging an investigation into alleged hidden family fortunes to clear his name.

The challenges of Xi Jinping
China's new leadership to be announced next week promises to be ''the most diversified generation of leaders,'' Cheng said.

''This diversity can be found in the leader's educational backgrounds, in their career paths, in their policies and world views,'' he further said.

And for Xi Jinping, who will head this leadership, maintaining ''delicate balance on several fronts'' will be the key challenge.

''How to crack down on the vested interest groups of state-owned companies but not undermine the national competitiveness and lose the support of this key power base of the party? How to be seen as the top leader who places China's national interests above anything else but at the same time maintain a good personal relationship with the United States? How to satisfy the bureaucratic interests of the military but avoid a military conflict in South China Sea, East China Sea or elsewhere? How to pursue some bold political reforms but not lose control?'' are the tough choices, according to Cheng.

''Anti-corruption, clarifying the division of labor between the party and the government, and establishing the rule of law'' are the top challenges, according to Zhiyue.

Required Use of Condoms in Porn Movies

In Los Angeles County, voters were asked their opinion on whether or not actors in the adult film industry should be required to wear condoms and practice safe sex while shooting scenes in L.A. The Safer Sex in the Adult Film Industry Act, also called Measure B, was introduced in response to repetitive allegations of sexually transmitted disease outbreaks among adult film industry workers.

"Self-regulation has failed miserably when it comes to the porn industry," Michael Weinstein, president of the AIDS Healthcare Foundation, told Reason TV.

However, adult film producers beg to differ. "This isn't the government's place," Steven Hirsch, founder and co-chairman of Vivid Entertainment, said.

He continued, "There's several reasons the industry is against condoms. One is that it's just not needed. The testing procedures that are in place work, and work well. The performers are comfortable with the testing procedures, and the companies are comfortable with the testing procedures. Second reason is movies with condoms simply don't sell as well. People don't want to watch movies with condoms."

This ballot initiative only pertains to people in Los Angeles County, so Hirsch argues it wouldn't be fair to make one group of producers follow a law the rest of producers around the country wouldn't have to abide by.

Who Owns the Grand Canyon?

When Arizona voters arrived to the polls, they found themselves involved in a battle over boundaries.

Proposition 120 questions whether millions of acres of federal land in the state, including the Grand Canyon, should remain in the hands of the federal government, or officially become the property of Arizona's residents. The ballot measure, supported by the state's Republicans, seeks to amend the state's constitution to declare Arizona's sovereignty over the "air, water, public lands, minerals, wildlife and other natural resources within the state's boundaries."

The proposition is part of the "sagebrush revolt" - Republicans in the West aim to regain control of land owned by federal agencies, particularly the Interior Department's Bureau of Land Management.

The Right to Hunt and Fish

In Nebraska and Wyoming, two states where hunting and fishing seem like second nature, voters officially had the chance in this election to establish their right to hunt and fish.

In 2010, Arizona, Arkansas, South Carolina and Tennessee all had similar measures on their ballots. All states passed the right to amend their states' constitutions to allow the right to hunting and fishing, except Arizona.

Idaho is also considering a similar initiative this year. The Idaho Fish and Game Commission have opposed lawmakers' efforts to make hunting, fishing and trapping a constitutional right for more than 10 years. However this year, Twin Falls Republican Sen. Lee Heider was finally successful in getting the issue on the ballot, asking Idaho voters to add language saying "the rights to hunt, fish and trap ? shall forever be preserved" to the state constitution.

Harsher Punishments for Animal Cruelty

In North and South Dakota, animal cruelty is only a misdemeanor. But on Tuesday, North Dakota voters had the opportunity to change the fact that animal cruelty is punished the same as littering on their ballots.

North Dakota voters weighed in on Measure 5, which would allow harsher punishments for animal abuse cases involving live cats, dogs or horses. The specific actions the measure cracks down upon are maliciously and intentionally burning, poisoning, crushing, suffocating, impaling, drowning, blinding, skinning, beating to death, dragging to death, exsanguinating, disemboweling or dismembering.

Legalize Marijuana

Three states voted on the legalization of marijuana Tuesday. Colorado, Oregon and Washington all considered making the drug a legal product that would be regulated by the state. Those who want to decriminalize marijuana say that it would be taxable so the state government could make money. They also argue it would create jobs.

Opponents say it would just promote marijuana use. It's also being argued that if only one state chooses to legalize the drug, it would increase production and cause price drops across the country.

Must Label Genetically Modified Food

One of the most controversial ballot measures is California's Prop 37, which states that all genetically modified food must be labeled as such in grocery stores.

According to the Washington Post, more than 88 percent of corn and soy grown in the United States is genetically modified in some way. Consumer watchdogs and organic food companies say Californians deserve to know what they are eating.

Corporate food and bio tech companies have spent more than $44 million fighting the proposition, saying it will raise food prices and hurt businesses.

Danny Boyle opposes plan to sell Moore sculpture

LONDON (AP) ? Director Danny Boyle has joined leading British arts figures urging a cash-strapped local authority not to sell off a valuable Henry Moore sculpture ? arguing it should be erected in London's Olympic Park instead.

"Draped Seated Woman" is owned by London's Tower Hamlets Council and stood for years on a public housing complex in the city's East End.

It was moved in 1997 to a sculpture park in northern England.

Last month the council announced plans to sell the artwork to offset funding cuts. Estimates of its value range from 5 million pounds to 20 million pounds ($8 million to $32 million).

Boyle, who directed London Olympics' opening ceremony, said Monday that the sculpture was priceless because it "defies all prejudice in people's minds about one of London's poorest boroughs."

CINCINNATI, Ohio -- At least two protesters were removed from a rally for President Barack Obama? here Sunday after they interrupted his speech by shouting from the bleachers.

A few moments into Obama's address at the University of Cincinnati basketball arena, a man seated in the upper rafters stood up and began shouting down the president about abortion. He held up a sign upside down that read "This Moral Wrong Should Never Be A Constitutional Right" and continued yelling, but the crowd of 13,500 drowned him out with a chant of "Four more years!" The incident forced the president to stop his speech and the man continued shouting until five police offers hauled him out of the arena. When Obama began speaking again, another man on the other side of the arena tried to shout him down again, but was quickly escorted out.

"These might have been some Tennessee Titans fans who were mad about the Bears beating them really badly today," Obama joked, before resuming his speech.

Obama's Sunday evening rally was the second-to-last time he will campaign in this state that both he and Republican Mitt Romney view as crucial to winning the election Tuesday.

Joining the president was musician Stevie Wonder, who entertained the crowd before Obama's speech and played a set when he finished. Between numbers, Wonder slammed Romney for comments he made last spring at a closed-door fundraiser about how "47 percent" of the population who would never support him.

"When I hear somebody talking about the 47 percent don't matter, that's unacceptable," Wonder said.

While he played the piano, Wonder went on to discuss abortion policy before continuing his set.

"Men are making an issue about the woman's body," Wonder said. "The reality is, I know--and all us men in here know--that if women were taking control of our bodies making decisions, we wouldn't like that. Is this too real or can you handle it?"

With that, he and his band perform "A Time to Love."

Obama will return to the state Monday for a final rally in Columbus.

NEW YORK - Without power in Manhattan since the storm Sandy hit, Doug Block is in denial about his car. The 2003 Pontiac Vibe is in a garage on East 20th Street - a good two blocks from the East River - and flooded, probably over the top of its hood. Block, 59, has not seen the car yet, does not really know what condition it is in, and he does not quite know what to do about it.?

"My wife filed a claim with State Farm, and we're waiting to hear back from them," says Block via email. "We haven't even been able to get in far enough to assess the damage. But we talked to others parked near where we are, and their cars were ruined, so we're assuming the worst."?

Block, a documentary filmmaker, and his wife, a law professor who teaches on Long Island, are now trying to rent a car so she can get to work, but available vehicles and gas are sparse in Manhattan.?

So, for now, they wait.?

While the attention after the storm has been on those with working cars who cannot get gas, there are potentially hundreds of thousands of flooded cars across the region. An iconic picture of storm damage shows a whole taxi fleet in Hoboken under water.?

State Farm's car claims were up to 8,000 on Thursday afternoon - almost as many claims as the company got for Hurricane Irene last year, and double what the claims were the day before. USAA, another insurer, says 4,000 auto claims have been reported through Thursday afternoon.?

By comparison, after hurricane Katrina, there were 325,000 known vehicles that were flooded, says Frank Scafidi, public affairs director of the National Insurance Crime Bureau.?

This storm could yield a similar number, but not everyone with a flooded car due to Sandy has filed a claim yet.?

Captain Paul F. Beglane of the U.S. Marines is marooned on an oil barge in a hurricane berth in Newark, New Jersey. His truck, however, is in Red Hook, Brooklyn, and it's likely flooded. "The waterways are closed to all but emergency traffic and Port Newark's port security won't let any mariners on or off our vessels while we're moored to their dock," Beglane said via email.?

Time to file
There's no particular rush for Beglane, says State Farm spokesperson Holly Anderson, since most cars that are flooded past the dashboard are totaled by the insurance company. The electronics inside are just too sensitive to water, and most of them are so expensive to fix that an older car is more economical to just scrap.?

The good news is that car owners with comprehensive coverage are covered for water events, and likely won't face the same sort of hurdles with insurers as homeowners who may have various parts of coverage denied or haggled over.?

Cars with minimal damage can be fixed, if they are dried out properly. Insurers suggest having a wet car examined by a mechanic before starting the engine. "Flooded cars are not always totaled," according to Nicole Alley, a USAA spokeswoman. "It depends on the water level and type of water - salt, brackish or clean water."?

The downside is that the dollar value of a totaled car may not match up with its functional worth to a family. Block, for instance, has a $500 deductible, and isn't expecting much cash in return for his 10-year-old set of wheels. "It's too bad since we loved the car and it was running fine - mostly because we put a good amount into repairs in the past year," he says.?

If you don't know what condition your car is in, like Beglane, however, you can file a claim and get an insurance adjustor to take a look.?

And what if you can't locate your car because it floated away? The insurance company can deal with that, too. "We won't go look in the bottom of the ocean, but if your car floated away, it's something that's going to be totaled out anyway," State Farm's Anderson says.?

Trouble down the road
The real trouble comes later, if cars that have been totaled or have been refurbished after flooding go back on the market without the proper disclosure.?

"People who are savvy enough can pick up a salvage vehicle and have a decent vehicle to sell, but they know it's been flooded," says Scafidi of the National Insurance Crime Bureau.?

What is supposed to happen when an insurance company totals a car is that the title gets branded as having been flooded and totaled. That record should be available to the public, via a database maintained by The National Insurance Crime Bureau, or a service like CarFax. Also, if a car has been flooded, but not totaled, that is supposed to be noted on its records. But that doesn't always happen.?

"A seller can get a clean title from state x and sell in state y, and that buyer is none the wiser," says Scafidi. That is, until the car starts falling apart or growing mold.?

Block says he will miss his Pontiac, but realizes how blessed he is in the scheme of things. "Things could be better, for sure, but they sure could be a whole lot worse," Block says.?
